Agreement between Sellers & Buyers:

All sellers and bidders must be of legal age - capable of fulfilling all legal obligations as well as complying with the terms and conditions of the BLOOMING AUCTION.

Listings: 

  1. There are no fees for listing on this website.  One gallery picture, and one image in the listing is included free of charge. Sellers pay a straight 5% end of auction commission ONLY if  the item sells.  There is no relisting fee, however the same 5% end of auction fee applies if an item sells after being relisted.  The buyer pays no premium.

  2. Listing durations for auctions range from 3 -14 days.  Fixed price items may use the 30 day option. When posting a new item, sellers may choose to utilize the "Auto Relist" option.   If a multiple item auction is relisted automatically through The BLOOMING AUCTION, only the remaining number of items available from the original listing will be relisted.

  3. It is requested that since there are no listing fees, that identical auctions be listed no more than 3 times concurrently.  By utilizing the "Fixed Price" category, the seller is able to list as many multiple items as desired.

  4. The BLOOMING AUCTION is a family website.  Only "APPROPRIATE" Flower and Garden Items shall be listed on this site.  Inappropriate Items will be deleted and the seller will be suspended.  If you have a question about an item, please email:  webmaster@bloomingauction.com

Seller's Agree: 

  1.  The seller affirms that he/she is the owner or agent of the merchandise listed on the auction, and is in possession of said item at the time of auction.
  2.  If the seller sets a low starting price, he agrees to sell the item to the highest bidder - even if there is only one bid at the starting bid amount.
  3.  The sellers agrees to hold to the terms of his auction as stated.
  4.  Sellers many not change the description of an item after a bid has been placed.  If there are clear typographical errors in the listing, please revise your item before a bid is placed.
  5.  Sellers may not email bidders participating in an open auction being run by a different seller, offering to 
sell similar or same items at any price.
  6.  Sellers, please be as accurate and as thorough as necessary to avoid misunderstandings with buyers.  Please give as much accurate information about the item as you can, as well as stating your shipping policies and charges.
  7.  Sellers and buyers agree to contact each other within three (3) days after the auction ends.
  8.  Sellers may not bid on their own auctions and sellers may not request other members to use an alias identity to place bogus bids on auctions for any reason.
  9. Users may not bid in a way that pulls other bidders to their maximum bid, or retract a high bid, and then rebid at a smaller increment above the legitimate high bidder. 
  10.  All Bidding is in US dollars.  International customers may select the currency option for approximate values in their preferred currency.
  11.  Any user who does not have their current and correct contact information in their registration, is not a valid user until their contact information is updated.  Please make sure your email address is current and valid before placing a bid!
  12.  Sellers may not post items or attempt to sell through The BLOOMING AUCTION any item that, by paying the listing fee, could cause The BLOOMING AUCTION to violate any applicable laws, statutes, ordinances or regulations. 

Buyers Agree: 

  1.  It is the buyer's responsibility to ask any questions BEFORE bidding on an auction. If you are unsure about anything in the item description, please  email the seller. 

  2. As soon as the auction is completed, it becomes the buyer's responsibility to complete that transaction.

  3. Sellers and buyers agree to contact each other within three (3) days after the auction ends. 

  4.  Successful Bidder must pay seller within 10 days of Auction close.  Unless you are familiar with the seller, the buyer should always wait until he has received an email response from the seller before sending payment.  If a buyer wishes to take longer than 10 days to make payment, the buyer must ask the seller for an extension before a bid is placed. This rule does not apply to cases where a seller does not respond to attempted email contacts by the buyer.  However, if this happens, please report such to The BLOOMING AUCTION web master immediately. 

  5.  Payment from the buyer to the seller is due per individual auction terms.

  6.  Bids are not retractable, except in exceptional circumstances.

  7.  Users may not bid in a way that pulls other bidders to their maximum bid, or retract a high bid, and then rebid at a smaller increment above the legitimate high bidder. 

  8.  Any user who does not have their current and correct contact information in their registration, is not a valid user until 
their contact information is updated.  Please make sure your email address is current and valid before placing a bid!  If the buyer cannot authenticate the identity of the seller, please contact the auctioneer. 

  9.  All Bidding is in US dollars.  International customers may select the currency option for approximate values in their preferred currency.

  10.  If you do not agree with any terms of service, please do not, and contact the auctioneer.

Conduct: 

The Blooming Auction reserves the right to cancel the registration of any member at any time.  Examples conduct which might result in cancellation include: 

  1.  Bogus bidding or non-payment. 
  2.  Illegal, deceptive, abusive, malicious, grossly inappropriate, or unethical actions are grounds for termination.
  3.  Use of false identity or deceptive bidding.
  4.  Uploading anything to our server which contains a virus or might damage the operation of the site.
  5.  Any disputes arising from a transaction or failure to complete a transaction shall be exclusively between the buyer and seller. Blooming Auction, The Blooming Auction, assumes no liability for any damages caused to buyers or sellers due to failure to complete a transaction. Blooming Auction, The Blooming Auction makes no guarantee that any bidder will be willing or able to complete a transaction.
6.  Only APPROPRIATE Flower, garden or similar items shall be listed on this site.  Inappropriate Items will be deleted, and the seller will be suspended.  If there is a question regarding whether an item would be allowed, email:  webmaster@bloomingauction.com

Feedback Ratings: 

  1.  Feedback can be a very important tool for you to use when buying or selling.

  2.  Each user is given a feedback rating based on the # of positive and negative comments they have received from other users as they buy and sell.  Members receive +1 point for a positive feedback comment, -1 point for a negative feedback comment, and 0 points for a neutral comment.
  3.  Be sure to check a user's feedback before bidding on an item to make sure they are trustworthy.

General:

  1.  Any policy can be amended/or changed by posting it on this site, and it will go into effect 30 days after posting.
The BLOOMING AUCTION may at our sole discretion add, delete or change some or all of our services at any time.

  2.  The BLOOMING AUCTION can not be held liable for loss of sales, the rare event of server malfunction.

  3.  The BLOOMING AUCTION reserves the right to delete or edit any listing at any time. The BLOOMING AUCTION is a family website. Only APPROPRIATE Items shall be listed on this site.  Inappropriate Items will be deleted  the seller will be suspended. 

  4.  Sellers may not post items or attempt to sell through The BLOOMING AUCTION any item that, by paying the listing fee, could cause The BLOOMING AUCTION to violate any applicable laws, statutes, ordinances or regulations. 

 5.  By registering with The BLOOMING AUCTION, you are agreeing to the above terms & guidelines.
